Refer a Friend Offer

1. THE PROMOTER

a.      The Promoter is Greystar Europe Holdings Limited of The Gilbert, 40 Finsbury Square, EC2A 1PX (the ‘Promoter’).

2. TERMS

a.      These standard terms and conditions (‘Terms’) constitute the entire agreement between a Referrer and the Promoter with respect to the matters set forth herein, and no oral statements or prior written matter not specifically incorporated herein shall be of any force or effect at the time of entering the Promotion and/or redeeming the Reward.

b.      These Terms apply to the Promotion and by making a Qualifying Referral you are agreeing to be bound by these Terms.

3. PROMOTION PERIOD

a.      The Promotion shall remain open until such time as the Promoter determines a closing date (‘Closing Date’), which will be communicated through applicable property marketing materials.

b.      All Entries (i) received after the Closing Date, and/or (ii) that do not meet all Eligibility Requirements are automatically disqualified.

c.      For the avoidance of doubt, the Reward is not redeemable in respect of any other property owned or managed by the Promoter.

d.      The Promoter will not accept:

i.       responsibility for Entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or

ii.     proof of transmission as proof of receipt of Qualifying Referral to the Promotion.

4. ELIGIBILITY

a.      For the Referrer to qualify for the Reward, the Referrer must have notified the leasing team at the participating property in writing of the referral and meet the following criteria (‘Qualifying Referral’):

i.       ‘Referrer’: A Referrer is a current resident of the participating property who holds an active tenancy agreement at that property.

ii.     Has referred a Referred Friend by passing the referral to the leasing team at the participating property.

iii.    Must currently hold a tenancy at the participating property at the time the Reward is issued.

‘Referred Friend’

b.      The Referred Friend must:

i.       Enter into a Tenancy Agreement with the Promoter at the participating property.

ii.     Complete all associated paperwork and pass any checks required by the Promoter.

iii.    Pay their first full month of rent and deposit.

iv.    Have moved into the participating property.

c.      Any terms not defined in these Terms shall have the same meaning as defined in your Tenancy Agreement.

d.      In entering the Promotion, you confirm that you are eligible to do so and eligible to claim a Reward.

e.      By making a Qualifying Referral, you are agreeing to be bound by these Terms.

f.      The Promoter may require you to provide proof that you are eligible for the Reward, and by applying for the Reward, you confirm that you are eligible to do so.

g.      There is a limit of one (1) Reward per household per referral. Residents may make multiple referrals.

h.      Referrals on behalf of another person and/or Referrer will not be accepted. For the avoidance of doubt, the Reward will only be given to the person named on the Tenancy Agreement.

5. THE PROMOTION

a.      The Referrer who submits a Qualifying Referral before the Closing Date will be eligible for a voucher reward. The value of the voucher will be as advertised in the applicable property marketing materials at the time of the referral.

b.      The Reward will be issued to the Referrer only, following a qualifying period of thirty (30) days from the commencement of the Referred Friend’s tenancy, provided that:

i.       the Referred Friend’s tenancy remains active and has not been served notice to terminate at the point the Reward is due to be issued; and

ii.     the Referrer continues to hold an active tenancy at the participating property.

c.      Referrers who are eligible are responsible for all other costs and arrangements associated with their Tenancy Agreement, including any necessary travel documents, passports and visas.

d.      The Promoter reserves the right to rescind the Reward for the Referrer if either party terminates their tenancy early.

6. PARTICIPATING PROPERTIES

a.      This Promotion is available at participating Greystar properties as specified in the applicable property marketing materials. Please refer to your property’s leasing team for confirmation of eligibility.

7. ANNOUNCEMENT

a.      The Referrer who has successfully submitted a Qualifying Referral will be contacted by the Promoter following the qualifying period of thirty (30) days from the Referred Friend’s move-in date, subject to the conditions in section 5(b) being met. The Promoter will clearly advise how to claim this offer.

b.      Referrers will have 7 days from being notified to claim their Reward. If the Referrer has not claimed their Reward within this period, they lose their right to claim the Reward.

8. LIMITATION OF LIABILITY

a.      Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate any Referrer and/or entrant or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Promotion and/or Reward except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

b.      The Promoter accepts no responsibility for any disappointment of any kind suffered by any entrant in entering the Promotion, including as a result of any entrant being rewarded or not rewarded with a Reward.

9. DATA PROTECTION AND PUBLICITY

a.      You agree that the Promoter may use your name, image and town or county of residence to announce the same and for any other reasonable and related promotional purposes.

b.      You further agree to participate in any reasonable publicity required by the Promoter.

c.      By entering the Promotion, you agree that any personal information provided by you with the Qualifying Referral may be held and used only by the Promoter or its agents and suppliers to administer the Promotion.

10. GENERAL

a.      The Promoter reserves the right in its absolute discretion to disqualify any Qualifying Referral if it has reasonable grounds to believe that an entrant has breached any of these Terms or any applicable law. Each Referrer acknowledges and agrees that any failure to comply with these Terms could lead to the Promoter disqualifying that person, without the Promoter giving any reason for such disqualification or granting any opportunity for challenge.

b.      The Promoter reserves the right to cancel or amend all or any part of the Promotion and/or Terms without notice and at its sole discretion where it becomes necessary to do so, including for any event that is outside of the Promoter’s reasonable control. Any changes to these Terms, or cancellation of the Promotion, will be communicated through applicable property marketing channels. It is the responsibility of entrants to keep themselves informed as to any changes to these Terms.

c.      This Promotion is subject to limited availability and will be available on a first come first served basis. The Rewards are not transferable to another individual and no cash or other alternatives will be offered.

d.      The Reward cannot be redeemed in conjunction with any other offer or promotion.

e.      These Terms and any dispute or claim arising out of or in connection with them or their subject matter (including the Promotion), existence, negotiation, validity, termination or enforceability (including non-contractual disputes or claims) shall be governed by the laws of England and Wales.

f.      The Courts of England shall have exclusive jurisdiction in relation to any dispute or claim arising out of or in connection with these Terms or their subject matter, existence, negotiation, validity, termination or enforceability (including non-contractual disputes or claims).
